These terms cover your use of the outdusk game ("the app"). By installing or using the app, you agree to them.
The game
outdusk is a free arcade game provided as-is for your personal entertainment. It is fully offline: it needs no account and no internet connection to play.
Licence
You are granted a personal, non-exclusive, non-transferable licence to install and play outdusk on devices you own or control, for non-commercial personal use. You may not copy, redistribute, sell, reverse-engineer, or create derivative works from the app except where such restriction is prohibited by applicable law.
No purchases, no ads
outdusk contains no advertising and no in-app purchases. All runners, colours and features are available from the start at no cost.
Your data
Your scores, relics, streak and settings are stored locally on your device. outdusk does not collect or transmit them. See the Privacy Policy for details.
Availability and changes
The app is provided without any guarantee of continuous availability. Features may change, and the app may be updated or discontinued at any time.
Disclaimer of warranty
outdusk is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. You use the app at your own risk.
Limitation of liability
To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the app.
Apple App Store terms
outdusk is distributed through the Apple App Store. Apple's Licensed Application End User License Agreement (Standard EULA) also applies, and where its consumer-protection provisions are required by law they prevail over these terms. The following clauses are included to meet Apple's requirements for apps distributed on the App Store.
- Between you and the developer only. These terms are concluded between you and Lorik Bajrami (the developer), not with Apple. The developer, not Apple, is solely responsible for outdusk and its content.
- Scope of licence. Your licence to use outdusk is limited to a non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. The developer is solely responsible for any maintenance and support for outdusk. Apple has no obligation to furnish any maintenance or support services.
- Warranty. The developer is solely responsible for any product warranties, whether express or implied, to the extent they are not effectively disclaimed above. outdusk is free of charge; should the app fail to conform to any applicable warranty, you may notify Apple and Apple has no other warranty obligation with respect to the app.
- Claims. The developer, not Apple, is responsible for addressing any claims relating to outdusk, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar law.
- Intellectual property. If a third party claims that outdusk infringes its intellectual-property rights, the developer, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of any such claim.
- Legal compliance. By using outdusk you represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right (and are deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
